JumpwithMe — Terms of Service

1. The service

JumpwithMe is an AI-generated entertainment product offered through nevaimoreno.com. After payment, we use AI to generate personalized photos and/or video where you appear alongside the AI persona "Nevai Moreno" in iconic locations. Delivery is by email, typically within 5 to 15 minutes. Maximum delivery window is 24 hours.

2. AI disclosure

You acknowledge that all media delivered through JumpwithMe is AI-generated. The photos and video are not real captures of you with Nevai Moreno; they are AI composites built from your uploaded selfie. The Nevai Moreno persona is itself AI-generated. Outputs are intended for personal entertainment use only.

3. Eligibility

You must be at least 18 years of age to use JumpwithMe. By placing an order you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding contract.

4. Your responsibilities for uploaded photos

By uploading a photo, you confirm that:

• You are the person shown in the photo, OR you have explicit, written consent from the person shown.
• The person shown is at least 18 years of age.
• You will not upload photos of public figures, celebrities, or other identifiable third parties without their consent.
• You will not upload photos for the purpose of impersonation, harassment, defamation, or any unlawful activity.
• You assume full legal responsibility for any photo you upload and indemnify Nevai Moreno, its operators, and Viralia for any claim arising from your uploads.

We reserve the right to reject any order at our discretion and refund the payment if the uploaded content appears to violate these terms.

5. Use restrictions on the delivered content

The photos and video delivered to you may be used for personal, non-commercial purposes only — including posting on your personal social media accounts. You may NOT:

• Use the content to impersonate another person or mislead an audience.
• Use the content for any commercial purpose, advertisement, or endorsement.
• Resell, redistribute, or sublicense the content.
• Use the content to create deepfakes intended to defame or harass.

6. Regeneration & refund policy

• Free regeneration: If you are not satisfied with the result, we will regenerate your order once at no extra cost. Email us within 7 days of delivery.
• Refund: If the regenerated result is still unsatisfactory, you are entitled to a full refund. Email us within 14 days of delivery.
• Refunds are not available once you have shared, posted, or distributed the delivered content.
• Refunds may be denied if the input photo did not meet the upload guidelines (e.g., poor lighting, occluded face, non-frontal angle).

7. No warranty on AI quality

AI generation is probabilistic. We strive for high-quality results but cannot guarantee any specific level of likeness, fidelity, or aesthetic outcome. The regeneration and refund policy in Section 6 is your sole remedy for unsatisfactory output quality.

8. Intellectual property

You retain rights to your uploaded photo. The Nevai Moreno persona, brand, name, and likeness are the property of the operator. The composite output combines your photo with the Nevai persona; you receive a personal, non-commercial use license to the delivered output as described in Section 5.

9. Limitation of liability

To the maximum extent permitted by law, in no event shall Nevai Moreno, its operator, or Viralia be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of JumpwithMe, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses. Our total liability for any claim is limited to the amount you paid for the order in question.

10. Indemnification

You agree to indemnify and hold harmless Nevai Moreno, its operator, and Viralia from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your uploaded photos, or your use of the delivered content.

11. Changes to these terms

We may update these terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the service after changes constitutes acceptance.

12. Governing law

These terms are governed by the laws applicable to the jurisdiction in which the operator is established. Any dispute shall be subject to the exclusive jurisdiction of the courts of that location.
